Copyright law, as mentioned before, is built around a model where expression is the root unit of communication. To build a system for the future, we must create some other model that models communication... and the more-complete communication model described earlier can again guide us.
In light of that model, it's fairly easy to break things down into two parts: the concrete part(s), and the human-received message. While they are very strongly related to each other, they are not the same thing and you must understand them both separately before their interactions can be understood.
